The Leasehold Property Enquiries form (LPE1) second edition was released on the 1st October 2015 along with the addition of the new Buyers Leasehold Information summary (LPE2).
The updated form has been endorsed by fourteen organisations across the legal and conveyancing, estate agency, property and leasehold sectors and should be used to collect the information required for the conveyancing process.
GUIDANCE FOR SOLICITORS/CONVEYANCERS ACTING FOR THE SELLER
The LPE1 and additional new LPE2 have been drafted to ensure that all relevant information is captured from the Lease Administrator in a comprehensive and logical way.
The intention is that the information supplied will prevent the need for additional enquiries save for clarification of issues raised by the form or matters requiring clarification due to the nature of the property or the buyers instructions to their own conveyancing lawyer. The penultimate paragraph on the form endorses this approach.
In cases where there are multiple parties involved in the administration of the Lease and Section 1 is intended to capture the information necessary for you to ascertain whether further copies of the form need to be sent to additional parties to obtain the relevant information on, for example, the collection of rents, service charges and the receipt of notices.

The LPE1 and additional new LPE2 have been created in collaboration with the legal sector to ensure that the information requested will be relevant, but also to reduce the number and variety of questions raised. Please answer the questions fully so that the conveyancing lawyers have sufficient information to advise their clients and to ensure that the incoming tenant is aware of their obligations.
The questions have been worded to avoid unnecessary liability and to ensure that you are not put in a position where you might breach the data protection regulations.
The format has been structured to aid the completion of the form and to create a logical approach to the process.
It is anticipated that by using this form it will reduce the number of additional enquiries to only those necessary to clarify issues revealed by your answers.
